Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RunPass Media and National Clearinghouse of College Recruiting websites, content, communications, athlete profiles, evaluations, and related media or recruiting services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and Authority

You must be at least 13 years old to submit information or create an interaction through the Services. If you are under the age of legal majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian. If you use the Services for a school, team, business, athlete, or another person, you represent that you are authorized to act for that person or organization and bind them to these Terms.

2. The Services

RunPass produces and distributes sports media, stories, podcasts, magazines, newsletters, and related content. NCCR may collect, organize, evaluate, verify, and share athlete and recruiting information with athletes, families, coaches, evaluators, event operators, college programs, and other authorized participants. We may add, remove, suspend, or modify features at any time and do not guarantee that any particular content or service will remain available.

3. No Recruiting, Scholarship, or Eligibility Guarantee

Evaluations, rankings, profiles, media exposure, events, data products, and communications are informational tools only. RunPass and NCCR do not guarantee recruitment, contact from a college, roster placement, admission, a scholarship, financial aid, professional opportunities, or any particular athletic outcome. Recruiting decisions are made independently by schools, coaches, conferences, and other third parties.

You are responsible for confirming academic, amateurism, transfer, name-image-likeness, eligibility, and recruiting requirements with the applicable school or governing body. Unless expressly stated, RunPass and NCCR are not affiliated with or endorsed by the NCAA, NAIA, NJCAA, any conference, school, league, or professional sports organization.

4. Accuracy of Information

Recruiting information can change quickly and may come from athletes, families, coaches, schools, events, evaluators, public sources, or other third parties. We may review or verify information, but we do not guarantee that every measurement, statistic, evaluation, schedule, roster, ranking, statement, or profile is complete, current, or error-free. You should independently verify information before relying on it for an important decision. Contact us if you believe information is materially inaccurate.

5. User Submissions

"User Submissions" include athlete data, stories, photographs, film, audio, video, evaluations, comments, links, and other materials you provide to us. You retain ownership of your User Submissions. By submitting them, you grant RunPass and NCCR a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, edit, adapt, publish, display, perform, distribute, create derivative works from, and otherwise use the User Submissions to operate, promote, and improve the Services and to provide media, editorial, event, evaluation, and recruiting-related services. This license includes use of names, team and school affiliations, voices, images, likenesses, and biographical information included in the submission, subject to applicable law.

You represent that your User Submissions are accurate to the best of your knowledge; that you own them or have all rights, releases, consents, and permissions needed to submit and license them; and that our permitted use will not violate another person's privacy, publicity, copyright, trademark, contractual, or other rights. If a submission concerns a minor, you represent that you are the minor's parent or legal guardian or have obtained all legally required authorization from the parent or guardian. Do not submit confidential information or sensitive records that are not necessary for the Services.

We are not required to publish, evaluate, return, preserve, or use any submission. We may edit, decline, unpublish, or remove a submission in our editorial or business discretion. A removal request does not require us to recall material already lawfully distributed, published, archived, or incorporated into completed editorial work, except where required by law.

6. Acceptable Use

You may not use the Services to:

  • violate any law, regulation, eligibility rule, contract, or third-party right;
  • submit false, misleading, defamatory, threatening, exploitative, or unlawful material;
  • impersonate another person or misrepresent your identity, authority, or affiliation;
  • harass, exploit, endanger, or improperly contact an athlete or minor;
  • collect or expose personal information without lawful authority;
  • introduce malware, probe security, evade access controls, or disrupt the Services;
  • use automated tools to scrape, harvest, copy, or monitor the Services without written permission;
  • reverse engineer or attempt to extract source code except where law expressly permits it; or
  • use our content, data, or trademarks to train a commercial model or build a competing database without written permission.

7. Intellectual Property

Except for User Submissions and third-party materials, the Services—including their text, graphics, logos, designs, databases, compilations, software, photographs, audio, video, and other content—are owned by or licensed to RunPass or NCCR and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. No other rights are granted by implication or otherwise.

If you believe content on the Services infringes your copyright or other rights, email legal@runpassmedia.com with your contact information, identification of the protected work, the location of the material, a good-faith explanation of the issue, and documentation showing your authority to make the request.

8. Paid Services

If we offer subscriptions, event registrations, evaluations, packages, or other paid Services, the price, billing schedule, cancellation terms, and any refund policy presented at checkout or in a separate agreement will also apply. You agree to provide accurate billing information and pay authorized charges and applicable taxes. If those additional terms conflict with these Terms, the more specific terms control for that purchase.

9. Third-Party Services

The Services may link to or embed third-party websites, social platforms, streaming services, payment providers, events, schools, or other resources. We do not control those services and are not responsible for their content, availability, security, products, or data practices. Your use of a third-party service is governed by its own terms and policies.

10. Privacy

Our Privacy Policy explains how we handle personal information. By submitting information about another person, you confirm that you are authorized to do so and have provided any notice or obtained any consent required by law.

11. Suspension and Termination

We may restrict, suspend, or terminate access to the Services, decline a submission, or remove content if we reasonably believe these Terms have been violated, the Services are being misused, or action is needed to protect a person, organization, or the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination—including licenses already granted, ownership, disclaimers, limitations of liability, and indemnity—will survive.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." RunPass and NCCR disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, RunPass, NCCR, and their owners, officers, employees, contractors, affiliates, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, goodwill, or reputation; recruiting or eligibility decisions; or damages arising from third-party conduct, even if advised that such damages were possible. To the fullest extent permitted by law, our aggregate liability arising from the Services will not exceed the greater of $100 or the amount you paid us for the applicable Service during the 12 months before the event giving rise to the claim. These limitations apply only to the extent permitted in your jurisdiction.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RunPass, NCCR, and their owners, officers, employees, contractors, affiliates, and partners from claims, liabilities, damages, losses, and reasonable costs arising from your User Submissions, your misuse of the Services, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

15. General Terms

These Terms and any additional terms presented for a specific Service form the entire agreement concerning that Service. If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of our business. Nothing in these Terms creates an employment, partnership, joint-venture, agency, fiduciary, or franchise relationship.

16. Changes to These Terms

We may update these Terms as the Services or applicable requirements change. We will post revised Terms on this page and update the "Last updated" date. Material changes will apply prospectively, and we may provide additional notice where required. Your continued use of the Services after revised Terms take effect means you accept them.
